An agreement with the original developer of Plaza Towers killed a case against the city, a circuit court judge said Friday.

The current owners of Plaza Towers in downtown Grand Rapids sued the city for damages caused during flooding in 2013.

The lawsuit said an opening in the floodwall cut open to accommodate a riverwalk let flood waters seep into the basement of the building. Vehicles in the building's basement garage were damaged and residents were forced out of the buildings for months following the historic floods.

Grand Rapids City Attorney Catherine Mish told WOOD TV the judge at the Kent County Circuit Court, George Buth, dismissed the case because an agreement with the building's original owners prevents a lawsuit against the city.

The city denied fault in the case. Mish said she expects an appeal.
